Terms of Service

1. Acceptance of Terms

By registering for or using the KunarPay payment platform (the "Services") provided by KUNAR LTD ("KunarPay", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use our Services.

2. Description of Services

KunarPay provides payment processing services that enable merchants to accept card payments from customers through their e-commerce platforms. Our Services include:

• Payment session creation and processing
• Transaction routing and management
• Merchant dashboard and reporting tools
• WooCommerce payment plugin
• Webhook notifications and API access

3. Merchant Eligibility

To use our Services, you must:

• Be a legally registered business or sole trader
• Be at least 18 years of age
• Provide accurate, complete, and current business information
• Comply with all applicable laws and regulations in your jurisdiction
• Not operate a business in a prohibited category (see Section 8)

4. Account Registration

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at admin@kunar-pay.com if you suspect any unauthorised access to your account. KunarPay is not liable for any loss resulting from unauthorised use of your account.

5. Fees and Payments

Our fees are clearly displayed during onboarding and on our pricing page. By using the Services, you agree to pay all applicable fees. Fees are deducted automatically from transaction proceeds. KunarPay reserves the right to modify its fee structure with 30 days' written notice.

6. Settlement and Payouts

Settlement timelines and payout schedules will be communicated to you during onboarding. KunarPay reserves the right to hold funds where there is reasonable suspicion of fraud, excessive chargebacks, or breach of these Terms.

7. Merchant Obligations

You agree to:

• Only use the Services for lawful business purposes
• Maintain accurate product descriptions and pricing on your storefront
• Fulfil orders promptly and honour your refund policy
• Keep your integration and plugin up to date
• Cooperate with KunarPay in any chargeback or fraud investigation
• Not attempt to reverse-engineer, copy, or circumvent our platform

8. Prohibited Business Categories

You may not use KunarPay Services for businesses or transactions involving:

• Illegal goods, services, or activities
• Adult content or services
• Gambling or betting platforms
• Cryptocurrency exchanges or ICOs
• Firearms, weapons, or controlled substances
• High-risk financial services without appropriate licensing
• Any activity prohibited by applicable UK or EU law

9. Chargebacks and Disputes

You are responsible for all chargebacks, dispute fees, and associated costs arising from your transactions. KunarPay will notify you promptly of any disputes and assist with evidence submission where possible. Excessive chargeback rates may result in account suspension.

10. Data Protection

Both parties agree to comply with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Please refer to our Privacy Policy for full details of how we handle personal data.

11. Intellectual Property

All intellectual property rights in the KunarPay platform, including software, trademarks, and content, belong to KUNAR LTD. You are granted a limited, non-exclusive, non-transferable licence to use our Services for your business purposes only.

12. Limitation of Liability

To the maximum extent permitted by law, KunarPay's total liability to you for any claim arising from the use of our Services shall not exceed the total fees paid by you to KunarPay in the three months preceding the claim. We are not liable for indirect, incidental, or consequential losses.

13. Suspension and Termination

KunarPay reserves the right to suspend or terminate your account at any time if you breach these Terms, engage in fraudulent activity, or if required by law or our payment partners. You may close your account at any time by contacting admin@kunar-pay.com.

14. Changes to Terms

We may update these Terms from time to time. We will provide at least 14 days' notice of material changes via email or platform notification. Continued use of the Services after the effective date constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
